Covenants, Conditions and Restrictions (CC&Rs)


Convenants Conditions and Restrictions (CC&Rs) are also recorded and are a public document. If your association is missing a recorded official copy, your title company can get it for you.

In a nutshell, the CC&Rs cover how the property is to be used and taken care of. They bind the owners contractually to the project. Even if you didn’t receive a copy of it during escrow.

The CC&Rs contain “Use Restrictions” on a variety of issues such as pets, parking, and even rental. Sometimes they contain restrictions on flooring as well. CC&Rs also include what the association will maintain and repair and what the individual owner is responsible for.

CC&Rs are amendable subject to the voting guidelines stated in the CC&Rs. Usually the voting guidelines are high.

The CC&Rs are usually one of the most important documents because it does limit what the property owners are allowed to do.

Articles of Incorporation


The Articles of Incorporation is a document that establishes the legal “person” for the community association. It is filed with the state and is by definition public and can be requested to the Secretary of State for California. The articles give the name of the association, and clearly states that the association is non-profit mutual benefit corporation formed to manage a common interest development. They are amendable, but this happens very infrequently.

Subdivision Map or Condo Plan


Subdivision maps divide the land into “lots” in a planned development. The condominium plan breaks up the land or airspace into “units.” Both types of documents are recorded with the county recorder and are public record. The map or plan defines “common area” or “exclusive common use area” versus “separate interests” (lot or unit). That way, areas such as balconies and/or patios are defined.
